US Judge Mandates Release of Abrego Garcia from ICE Custody
A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment is without lawful basis.
"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.
The situation originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an error. After his return to the United States to face alien smuggling allegations, he was detained in immigration custody.
In her decision, the court noted that the government does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
